You can lose your right to possess a firearm, gun or ammunition if you are convicted of a domestic violence in ANY court in Alabama.


Domestic Violence is by definition

an act against a current or former spouse, parent, child, any person with whom the defendant has a child in common, a present or former household member, or a person who has or had a dating or engagement relationship with the defendant. Domestic violence charges incorporate by definition the crimes of assault, menacing, reckless endangerment, or harassment. (13A-6-130, 131 and 132, Code of Alabama, 1975 define Domestic Violence and include 13A-6-20, 21, 22, 23 and 24, Code of Alabama, 1975).

Federal law states,

"It shall be unlawful for any person - who has been convicted in any court of a misdemeanor crime of domestic violence, to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce." 18 U.S.C. §1988 (g)(9) (emphasis added.).  18 U.S.C. §1988 was a little noticed add-on "earmark" type law added to an omnibus spending bill. Its effect is to control gun ownership by making ownership of guns or ammunition a federal crime for everyone who has been convicted of a Domestic Violence charge. Only 37 states have criminal laws identifying domestic violence. Alabama is one of those states. If you have been arrested for or charged with domestic violence, call a lawyer immediately!
